Purpose

These Terms set out the conditions under which Nicomatic Senegal makes available the nicomaticsenegal.com website, the Portal, and all digital tools (" Catalogue") and agro-industrial processing equipment (" Factory") presented on it.

Acceptance of these Terms

Using the website, requesting a free trial, a demo, a quote, or subscribing to one of our tools implies full acceptance of these Terms, as well as our Privacy Policy.

Description of the Services

The Portal gives access to two distinct catalogues:

• Catalogue: digital (SaaS) tools offered as a free trial and/or a tiered subscription;
• Factory: agro-industrial processing equipment offered on a custom-quote basis, configured to the client's needs.

Account creation and free trial

Some Portal tools can be tried for free after filling in a form (name, professional email, phone, company). Your details are remembered for the duration of the trial to simplify later requests. You agree to provide accurate, up-to-date information.

reserves the right to refuse, suspend, or limit access to a trial in case of misuse or clearly inaccurate information.

Subscription and billing

When a tool offers several subscription tiers, the price, billing period, and included features are shown on the product page before any subscription. Prices are stated in CFA francs (XOF); displaying them in another currency on the site is for information only and has no contractual value. Any paid subscription is subject to prior confirmation from our sales team.

Permitted use

You agree to use the website and the Portal in accordance with their intended purpose and applicable regulations, and in particular not to:

• Attempt to access data, accounts, or systems that do not belong to you without authorization;
• Disrupt, overload, or alter the operation of the website, the Portal, or our infrastructure;
• Use our Services for fraudulent, unlawful purposes or purposes contrary to public order;
• Extract, copy, or reuse all or part of the website's content without prior authorization.

Intellectual property

All elements of the website and the Portal (text, logos, trademarks, visuals, software, databases) are the exclusive property of Nicomatic Senegal or the Nicomatic group, or are used under authorization, and are protected under applicable intellectual property law. Any reproduction, representation, or exploitation, in whole or in part, without prior written authorization is prohibited.

Factory machines: quotes and orders

The machines presented in the Factory catalogue are offered on a custom-quote basis. An order is final only after both parties have accepted a written quote setting out the technical specifications, price, timelines, and delivery terms specific to each piece of equipment.

Service availability

Nicomatic takes reasonable measures to keep the website and the Portal accessible, without guaranteeing continuous, uninterrupted availability. The website may be temporarily unavailable for maintenance, updates, or reasons beyond our control.

Liability

Nicomatic strives to ensure the accuracy of the information published on the website and the Portal, without being able to guarantee the complete absence of errors or omissions. Nicomatic shall not be liable for indirect damages resulting from the use or inability to use the website, the Portal, or any of the tools offered, to the extent permitted by applicable law.

Termination

Nicomatic may suspend or terminate a user's access to a trial or subscription, in particular in case of breach of these Terms, non-payment, or fraudulent use. The user may, for their part, end a subscription according to the terms indicated at the time of subscription or by contacting our team.

Personal data

The processing of your personal data in connection with your use of the website and the Nicomatic Portal is described in our Privacy Policy, which forms an integral part of these Terms.

Governing law and disputes

These Terms are governed by Senegalese law. In the event of a dispute regarding their interpretation or performance, and failing an amicable resolution, the competent courts of Dakar, Senegal, shall have sole jurisdiction.

Changes to these Terms
